Terms & ConditionsProduct WarrantyFor product warranty information please see our warranty page. Warranty services are provided as indicated in our warranty section which are incorporated herein by reference as if fully set forth below, and govern the products and services specified. Products that are distributed or resold by RF Linx are covered by the original manufacturer's warranty only. Shipments & Risk of LossAll shipments will be F.O.B. Origin, freight prepaid and charged back unless otherwise agreed upon and documented in writing by an authorized RF Linx agent. All purchases from RF Linx are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our release of goods to the carrier. RF Linx uses UPS as our primary carrier. RF Linx may use different carriers based upon the requirements of the shipment at our sole discretion. Any shipment discrepancies or damage must be reported in writing within five (5) business days of delivery. Send email to shipping@rflinx.com or fax to (513) 777-2115. Notification of discrepancies or damages after this period can not be acted upon and will be considered void. Please retain all original packaging to protect your ability to make a damage during shipment claim. Service Charges & Bench FeesRF Linx will provide service for out of warranty units as well as custom technical service. The standard bench or no problem found upon inspection fee is $40.00. Technical service that can be performed in 30 minutes or less will be charged the bench fee of $40.00 plus parts. Technical service that extends beyond 30 minutes will be charged $80.00 per hour billed in 1/4 hour increments plus parts. All shipping to and from RF Linx is the responsibility of the customer. Engineering services are not included in this fee schedule and will be determined on a case by case basis. Repair services, engineering fees, and custom work are non-refundable services. Additional ChargesItems returned to RF Linx by the shipping carrier as a result of customer error, refusal, or inability for the carrier to make delivery to the address provided will be the responsibility of the customer. Such costs will be charged to your on file credit card or account. If such option is not available the customer will be billed for such charges. Items returned to RF Linx may be assessed a restocking fee of 20% of the original purchase price or more based upon the condition of the returned items and the reason for return. Returned checks that have not been honored by the customer's bank are the responsibility of the customer. All returned checks will be assessed a $25.00 or 5% service fee whichever is the higher of the two dollar amounts and any and all additional charges or expenses related to the collection of this debt allowable by law. RF Linx Corp will take any and all measures to ensure returned checks are paid. This includes but is not limited to charging previously used charge cards, legal action civil and criminal as well as liens. Use of a check to pay for services constitutes your agreement to these terms. Duties & TaxesDuties, taxes, and all other fees are the sole responsibility of the customer. Order Changes, Cancellations, or ReturnsYou may request that we change or cancel your order as long as your order has not been processed. Online order changes or cancellations should be noted in the comment section of the applicable order. For orders placed directly with our sales team please email change requests for orders to sales@rflinx.com. Once an order has been processed it cannot be canceled. Some products may be returnable while other are offered as all sales final. Please carefully review your order prior to submission. Website & Publication AccuracyRF Linx Corp attempts to be as accurate as possible. However, RF Linx Corp does not warrant that product descriptions, prices, or other content of our website or publications is accurate, complete, reliable, current, or error-free. If a product offered by RF Linx Corp itself is not as described, your sole remedy is to return it in new and unused condition. Some product may be returnable while other are offered as all sales final. Please carefully review your order prior to submission. Applicable LawBy visiting RF Linx Corp you agree that the laws of the state of Ohio, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and RF Linx Corp or its affiliates. It is agreed that soul jurisdiction for any disputes or legal actions between RF Linx Corporation and any other party does reside with the court system in Hamilton County, in the State of Ohio. DisputesAny dispute relating in any way to your visit to RF Linx Corp or to products you purchase through RF Linx Corp shall be submitted to confidential arbitration in Hamilton County, Ohio, except that, to the extent you have in any manner violated or threatened to violate RF Linx Corp intellectual property rights, RF Linx Corp may seek injunctive or other appropriate relief in any state or federal court in the state of Florida, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise. Policies, Modifications, & ServerabilityPlease review our other policies. We reserve the right to make changes to our site, prices, policies, and these Conditions of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition. We reserve the right to deny any sale at our sole discretion. Volume PricingRF Linx Corp. posts our lowest available prices on the website for all customers. Special pricing based upon order volume may be available. Volume pricing must be based upon volume purchasing. For customers who believe that they will be purchasing over a period of time in higher volumes of like or similar items should contact the Sales Department directly for additional volume pricing information. CurrencyRF Linx lists all prices using United States Dollars. It is the responsibility of the customer to convert these prices into their local currency as necessary. FCC Part 15 and Part 97Customer acknowledges that any RF Linx amplification device it purchases is intended for use only in a transmission system certified under part 15/97 or other applicable section of the rules and regulations of the Federal Communications Commission. This condition applies only to customers who fall under the regulatory authority of the FCC. Other TermsRF Linx accepts no other terms or conditions than otherwise specified herein by RF Linx. Customer acknowledges that no other terms shall be binding upon RF Linx, it's agents or assigns other than those posted herein. Customer indemnifies RF Linx from any and all harm, damage, or loss other than those losses or responsibilities accepted herein. Disclaimer of Warranties and Limitation of LiabilityThis site is provided by RF Linx Corp on an "as is" and "as available" basis. RF Linx makes no representations or warranties of any kind, express or implied, as to the operation of this site or the information, content, materials, or products included on this site. You expressly agree that your use of this site is at your sole risk. To the full extent permissible by applicable law, RF Linx Corp disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose.
